PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.
This document outlines the Terms and Conditions for the Pilot Program scholarship administered by The Seneca Scholarship Program (“Seneca”). The Pilot Program scholarship will be referred to as “Scholarship” herein and is non-transferrable. By submitting an application for our Scholarship, you are agreeing to the Terms and Conditions set forth below. Failure to abide by any of the following Terms and Conditions shall result in either disqualification of the Scholarship or termination of the Scholarship.
Seneca will select one of the submitted applications and essays as the Scholarship Recipient. The potential recipient will be notified by email, at which time they may also be required to sign an individual Scholarship Agreement. Seneca shall have no liability for any potential Scholarship Recipient notification that is lost, intercepted, or not received by the potential recipient for any reason. Seneca reserves the right not to choose a Scholarship Recipient if, in its sole discretion, it does not receive a sufficient number of eligible and qualified applications. Portions of the Scholarship application by the Scholarship Recipient may be posted on the Seneca website, or used in other marketing materials, without further compensation or notice to the Scholarship Recipient.
You must read these Terms and Conditions in their entirety before you submit your Scholarship application and essay. If you receive a Scholarship, it will be governed by these Terms and Conditions, which, you are agreeing to by submitting your application and essay. Seneca may revise these Terms and Conditions at any time.
Applicants are required to produce their own essay. Any successful Applicant may be required to show legitimate proof of work via notes or other work product showing that they, and they alone, are the author of their essay. If there is reasonable doubt that the Applicant is the true author of their application essay, Seneca reserves the right to cancel the application.
The Applicant must be either a junior or senior currently enrolled in an Oregon high school institution, or a student pursuing a high school diploma or general education degree at an equivalent grade level.
The Applicant for the Scholarship must be a legal resident of the State of Oregon.
The Scholarship must be used at a state college or university in the State of Oregon and the Scholarship will be a one-time Scholarship of $5,000. Seneca will not fund a Scholarship for use toward out-of-state tuition. Therefore, Seneca will only provide an Applicant with a predetermined one-time Scholarship of $5,000 for use toward in-state tuition. There is no cash alternative to the Scholarship and the Scholarship Recipient shall not seek any refunds from Seneca.
This Scholarship is for a state college or university in Oregon (a list of eligible colleges can be found on the Seneca website). If the Applicant chooses a college other than a state school or university, Seneca bears no responsibility. The Scholarship will not be honored at a college or university located outside the State of Oregon. Seneca is not responsible for and cannot provide you with financial advice on taxation matters related to any Scholarship that may be awarded.
- Payment and Value of Scholarship
Seneca will administer a privately funded Scholarship in direct payment to the Oregon college or university of the Scholarship Recipient’s choice, within the requirements outlined in the Scholarship offer. Payment will not be distributed directly to the Scholarship Recipient.
The value of the Scholarship is for full-time credit tuition, fees, books, supplies, and equipment required for classes at Applicant’s primary state college or university in a one-time amount of $5,000, payable on the college or universities quarter or semester system. The value of the Scholarship does not exceed $5,000. The value of the Scholarship is in no way to be used for housing, food, or any other living expenses.
- Retaining your Scholarship
To retain your Scholarship, you must:
- Complete and receive a high school diploma or equivalent degree (GED).
- Enroll in a college or university in the State of Oregon and maintain such enrollment during the duration of the scholarship period.
- Maintain your status as a resident of the State of Oregon.
- Maintain a 2.0 GPA.
- Provide Seneca with access to academic status at all times during the payment of Scholarship.
- Not be placed on academic disqualification or denied admissions.
- Begin to utilize your scholarship (i.e. enroll in a qualifying college within 18 months of acceptance).
If you are found to be in violation of any of these requirements, payment of the Scholarship may cease or terminate.
Except where prohibited, by accepting a Scholarship, the Scholarship Recipient agrees that Seneca may, without any limitation or further compensation or notice, use his or her name, voice and/or likeness in any and all media, worldwide, for the purpose of advertising and promoting the Seneca website, Seneca, or the Scholarship Program offered by Seneca.
By submitting the Scholarship application and essay, Applicant acknowledges and agrees that (a) Seneca will own the application and essay submission, and (b) Seneca will own all publishing rights in and to the application and essay. Applicant hereby grants, transfers, assigns, and conveys to Seneca, its successors and assigns, all present and future, right, title, and interest of every kind and nature whatsoever, including, without limitation, all copyrights, and all rights incidental, subsidiary, ancillary, or allied thereto (including, without limitation, all derivative rights) in and to the application and essay. Seneca shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter, the application and essay submission for any purpose, which Seneca deems necessary or desirable, and each Applicant irrevocably waives any and all so-called rights in and to the application and essay submitted.
- Dispute Resolution
Except where prohibited, by participating, Applicant agrees that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of Applicant and Seneca and their agents, shall be governed by and construed exclusively in accordance with the laws of the State of Oregon without giving effect to any principles of conflicts of law of any jurisdiction. Applicant agrees that any action at law or in equity arising out of or relating to this Scholarship Program, or awarding of the Scholarship, shall be filed only in the state or federal courts located in the State of Oregon, and Applicant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Scholarship Program, Applicant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Scholarship Program, or awarding of the Scholarship, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Scholarship Program but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to all Applicants.
- Representations and Warranties/Indemnification
Each Applicant for this Scholarship Program represents and warrants to Seneca as follows: (i) the application, including the essay, is the Applicant’s own original, previously unpublished, and previously unproduced work; (ii) the essay submission is wholly original with Applicant and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the application and essay submissions neither infringe upon nor violate the intellectual property rights or other rights of any other person or entity; and (iv) the essay submission does not and will not violate any applicable laws, and meets the requirements set forth in these Terms and Conditions. Each Applicant hereby agrees to indemnify and hold Seneca harmless from and against any and all third party claims, actions, or proceedings of any kind and from any and all damages, liabilities, costs, and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations, or agreements of Applicant hereunder.
- General Release and Limitations on Liability
By submitting an application and essay for the Scholarship Program, each Applicant acknowledges and agrees that Seneca, its related companies, affiliates, and each such company’s respective employees, officers, directors, and agents are not responsible for any costs, injuries, losses, or damages of any kind arising from or in connection with: (i) selection and award of the Scholarship by Seneca, with all decisions for award of the Scholarship being final and non-reviewable by any Applicant or representative of Applicant; or (ii) incomplete, lost, late, misdirected or illegible entries or for failure to receive applications due to any cause, including without limitation human, transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender, or otherwise, that may limit an Applicant’s ability to participate in the Scholarship Program; or (iii) any injury or damage resulting, directly or indirectly, in whole or in part, from participation in the Scholarship Program, including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the Applicant’s rights of publicity or privacy, or the Applicant’s claim that he or she has somehow been defamed or portrayed in a false light. Seneca assumes no responsibility for any damage to an Applicant’s computer system, which is occasioned by accessing the Seneca website or participating in the Scholarship Program, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature, or for the incorrect or inaccurate capture of information, including any typographical error or omission in any of the materials related to the Scholarship, or the failure to capture any information. This Scholarship Program is subject to all U.S. federal, state, and local laws and regulations. Void where prohibited.
- Seneca’s Right to Modify, Suspend, or Terminate
In the event Seneca is prevented from continuing with the Scholarship Program by any event beyond its reasonable control, then Seneca shall have the right, in its sole discretion, to modify, suspend, or terminate the Scholarship Program.
- General Provisions
Seneca reserves the right, in its sole discretion, to disqualify any individual who is found to be tampering with the application process or the operation of the Scholarship Program or the Seneca website, to be acting in violation of these Terms and Conditions, to be submitting responses dishonestly or inaccurately, or to be acting in an unsportsmanlike or disruptive manner. In the event of a dispute as to the identity of any Applicant, the authorized account holder of the email address used to enter will be deemed the Applicant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. If an application is confirmed by Seneca to have been erroneously deleted, lost, or destroyed, the Applicant’s sole remedy shall be another application, if time permits. Seneca’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that or of any other provision.
In the event that any provision of the Scholarship Program or the Terms and Conditions shall be held void, voidable, or unenforceable, the remaining provisions shall remain in full force and effect.
- Privacy Notice
Applicant agrees that Seneca may collect, store, share and otherwise use information provided during the application process, including, but not limited to, name, mailing address, phone number, and email address, included for administering the Scholarship Program and verifying the Applicant’s identity.
